Musk’s xAI, SpaceX sued over ‘pervasive and inescapable’ data center power plant noise
The class action says the plant’s 24-hour noise has harmed health and property values for more than 10,000 residents, the suit says.
On Tuesday, three Mississippi residents filed a class-action lawsuit in Oxford against Elon Musk's xAI and SpaceX, alleging a Southaven power plant creates excessive noise and vibrations harming thousands.
XAI invested more than $20 billion to develop the facility with backing from Mississippi Governor Tate Reeves, utilizing gas-fired turbines to power data centers since the middle of last year.
Lawyer Robert Wiygul stated, "Our homes are supposed to be a sanctuary," describing noise as "omnipresent and inescapable" affecting a class estimated at more than 10,000 residents 24 hours daily.
Plaintiffs seek damages and profit disgorgement, naming subsidiary MZX Tech as defendant alongside xAI and SpaceX, though Musk is not personally named in the legal action.
The suit joins broader national opposition to AI infrastructure, including a separate NAACP environmental lawsuit and Senator Bernie Sanders' proposed AI Data Center Moratorium Act to halt new construction.
